Shopofthings.ch is an offering of Thingware GmbH, Brühlstrasse 20, 4415 Lausen, Switzerland (hereinafter “Thingware”).
As at: 1 January 2026 / version 3
Only the German version of these terms and conditions is legally binding. In the event of any discrepancy between the language versions, the German version prevails.
1. Scope
These general terms and conditions (GTC) govern the legal relationship between Thingware and its customers for all contracts concluded via the online shop at https://shopofthings.ch or via other sales channels that refer to these GTC.
The GTC form an integral part of every contract. Deviating conditions of the customer require the express written consent of Thingware.
Thingware primarily addresses its offering to customers domiciled or resident in Switzerland or Liechtenstein. Deliveries to other countries (e.g. the EU) are made only on express request and subject to reservation.
For contracts with companies (B2B) these GTC apply with priority; supplementary or deviating provisions in individual contracts take precedence.
2. Offer and conclusion of contract
The presentation of products in the online shop constitutes a non-binding offer. Prices are binding, subject however to errors, technical changes and price changes.
Product information, photographs and specifications are provided without warranty. The manufacturer’s specifications at the time of delivery are authoritative.
The contract comes into existence through the customer’s order and Thingware’s order confirmation.
Thingware reserves the right to reject orders without stating reasons.
Thingware is entitled to amend these GTC at any time. The version published on the website at the time of the order is authoritative.
3. Prices and payment terms
Prices are in Swiss francs (CHF), excluding Swiss value added tax (VAT). VAT is shown at checkout and is included in the final price.
For deliveries outside Switzerland/Liechtenstein the customer bears all country-specific taxes, customs duties and levies.
Payment is made by credit card, PayPal, invoice or advance payment. In the case of payment by invoice, the amount falls due within 14 days of the invoice date.
In the event of late payment, Thingware charges default interest of 5% p.a. as well as reminder fees of CHF 20 per reminder.
The goods remain the property of Thingware until payment has been made in full (retention of title).
4. Delivery and shipping
Available items are generally dispatched within 24–48 hours. Delivery periods are non-binding; delays give rise to no claims for damages and no right of withdrawal.
Shipping is at the customer’s cost and risk (from handover to the carrier). Shipping costs are shown before the order is completed.
Incoterms DAP (Delivered at Place) apply to deliveries into the EU. Additional customs duties/taxes are borne by the customer.
Thingware may make partial deliveries.
5. Inspection and notice of defects
The customer shall inspect the goods immediately upon receipt for completeness, correctness and damage. Transport damage must be reported without delay (at the latest 5 calendar days after receipt) to Thingware and to the carrier. The original packaging must be retained.
6. Warranty and liability
Thingware supplies factory-new products (unless stated otherwise).
The warranty period is 24 months from the date of delivery and covers repair, replacement or a price reduction at Thingware’s discretion.
Excluded from the warranty are: consumables (e.g. rechargeable and non-rechargeable batteries), kits, modules, components and assembly sets.
Where a longer manufacturer’s warranty applies, Thingware forwards the item to the manufacturer after the 24 months have expired, at the customer’s expense.
Thingware is not liable for the suitability of the products for a specific purpose or for compatibility with existing systems.
Liability for indirect damage, consequential damage or financial loss is excluded to the extent permitted by law.
No general right of return for goods free of defects (Swiss law provides no statutory right of withdrawal for distance contracts).
Returns (e.g. in a warranty case) require prior authorisation by Thingware and are made at the customer’s cost and risk.
7. Special products and services
7.1 Swisscom indoor/outdoor gateways Thingware supplies Swisscom indoor/outdoor gateways including installation instructions. Swisscom’s terms and conditions apply (linked on the product page).
Before the agreed service period expires, the customer informs Swisscom of any desired extension. Swisscom checks whether the gateways can continue to be used or whether new gateways are required. Good cause (e.g. new security standards, regulatory restrictions) may preclude continued use.
In the event of an extension, the monthly fees continue to run or are renegotiated. If continued use is not possible, the parties agree the price for new gateways separately.
If the service contract is terminated early, Swisscom will, at the customer’s request, continue to operate the gateways for the remaining service period or take them back. Fees already paid are not refunded.
7.2 LoRaWAN gateway SIM cards (Swisscom)
- Type: LoRaWAN gateway SIM card with activation QR code.
- Network coverage: the Swisscom network in Switzerland plus roaming according to the product model ordered (see the detailed product description on the relevant product page for current roaming zones and countries).
- Data volume: pooled, according to the product model ordered (sufficient for typical gateway use). Fair use policy: overruns are analysed; additional data (CHF 5.–/GB) is charged only in cases of misuse or improper conduct. Amounts below CHF 10.– are not invoiced.
- Subscription terms: starts on activation via the app. Unlimited term; notice of termination with 5 weeks’ notice to the end of a month. Optional limited term via a separate project (automatic deactivation).
- Billing: to the day, flexible (monthly, quarterly, half-yearly, annually or individually). The invoice contains the ICCIDs and, where applicable, device numbers.
7.3 Safety notes The products are intended for professionals, for development and experimentation. The customer bears full responsibility for safe and compliant use. Thingware accepts no liability.
8. Copyright and trade mark rights
All rights to texts, images, trade marks, logos and other content of the website as well as of the products remain with Thingware or the respective rights holders. Any use without express consent is prohibited.
9. Data protection
Personal data is processed in accordance with the revised Swiss Federal Act on Data Protection (revFADP) and, in addition, the GDPR (where there is an EU connection). For details see the separate privacy policy on the website.
Data is not passed on to third parties, other than to service providers acting on our behalf.
10. Written form and communication
Amendments and additions to the contract require the written form. This also applies to the waiver of this written form requirement. Electronic communication (e-mail) satisfies the written form requirement.
11. Severability clause
Should any provision of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a rule that comes closest to the economic purpose of the invalid provision.
12. Applicable law and place of jurisdiction
Swiss law applies exclusively.
The place of performance and exclusive place of jurisdiction is Lausen BL (Basel-Landschaft).
